On March 4, Executive Director Michael Sanderson gave in person testimony on behalf of Karrington Anderson to the Government, Labor, and Elections Committee in support of HB 1216 – Insurance – Certificates of Guarantee for County Bond Requirements – All Counties.
This bill authorizes counties to honor certificates of guarantee issued by a nonprofit association of contractors as an alternative to traditional surety bonds.
Currently, only a limited number of counties are authorized to accept contractor-issued certificates of guarantee as an alternative to traditional surety bonds. This legislation would extend this option statewide without mandating its use. By allowing jurisdictions to choose the approach that best fits their needs, the bill aims to support efficient development practices while maintaining appropriate safeguards for public infrastructure.
HB 1216 is a pro-housing, pro-flexibility measure. It does not mandate acceptance of
certificates of guarantee but rather empowers counties with an additional option that many jurisdictions are already using successfully. By expanding this authority statewide, the bill supports local decision-making, promotes cost-effective development, and maintains appropriate safeguards for public infrastructure.
