Radio Show Focuses on Fault Doctrine

On Baltimore public radio station WYPR’s show Maryland Morning, a September 17 discussion focused on the recently-argued case before the Maryland Court of Appeals, dealing with the standards for lawsuit filings.  The case has the potential to overturn decades of consistent policy in Maryland and open the doors to many more litigants filing suits against multiple defendants, commonly including “deep pockets” like governments.

It’s a legal doctrine called “contributory negligence,” and has been the law in Maryland since well before the Civil War. Now the state’s highest court may be poised to change it – a change that could have a big impact on consumers, insurers and businesses in the Free State.
